CONCILIATION ORDER
These criminal revision petitions are filed by the petitioner/accused praying to set aside the judgments and orders dated 01.12.2018 passed in Crl.A.Nos.137/2016 and 136/2016 by the LXV Additional City Civil and Sessions Judge, Bengaluru and also to set aside the judgments dated 20.01.2016 passed in CC.Nos.8863/2014 and 12783/2014 by the XVI Additional Chief Metropolitan Magistrate, Bengaluru, and consequential prayer to acquit him from the alleged offences. 4
2. Sri.Premnath N.T., learned counsel for the petitioner and Sri.Fahad M. Ali, learned counsel for the respondent are present along with their respective parties. 3. It is submitted that after detailed discussion, the matter is settled between the parties and they have filed a joint memo to that effect which reads as under:
"1. The petitioner and the respondent have agreed to settle the above matters amicably before the Lok-adalat held on 13.12.2025. 2. The Complainant/Respondent has agreed to receive the sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only). The petitioner has agreed to pay the said amount Rs.2,50,000/-. 3. The Petitioner/accused has no objections to withdraw the amount in deposit before the trial Court. The balance amount of Rs.40,000/- shall be paid by the petitioners within 15 days i.e., 27.12.2025 to the Complainant/Respondent. 4. The petitioner has deposited Rs.1,65,000/- and Rs.45,000/- totally Rs.2,10,000/- on 25.03.2019 as per the order of this Hon'ble Court in above cases. Over and above if any deposit amount is remaining or balance, the accused is at liberty to withdraw the said amount. Prayer
Wherefore the petitioner and respondent hereby pray that the Hon'ble Court may be pleased to consider this joint memo and pass necessary orders in accordingly in the interest of justice."
4. As per the joint memo, the respondent/complainant has agreed to receive a sum of Rs.2,50,000/- and the petitioner/accused has agreed to pay the said amount. It is recorded that the petitioner/accused has already
5 deposited a sum of Rs.2,10,000/- before the Trial Court. The respondent/complainant is at liberty to withdraw the amount deposited by the petitioner/accused before the trial Court i.e., Rs.2,10,000/-. The balance amount of Rs.40,000/- shall be paid by the petitioner/accused to the respondent/complainant within a period of 15 days i.e., on or before
27.12.2025. If any excess amount is in deposit, the petitioner/accused is entitled to withdraw the said amount. 5.
In view of the above, the judgments and orders dated 01.12.2018 passed by the LXV Additional City Civil & Sessions Judge, Bengaluru in Crl.A.Nos.137/2016 and 136/2016 confirming the judgments dated 20.01.2016 passed by the XVI Additional Chief Metropolitan Magistrate, Bengaluru in C.C.Nos.8863/2014 and 12783/2014 respectively are hereby set aside and the petitioner is acquitted from the alleged offences.
