CORAM:
HON’BLE THE CHIEF JUSTICE HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE
O R D E R 02-09-2025
Learned counsel for the respondent submits that the investigation in the matter has since been concluded, as the Challan against the accused, as also the Government sanction for prosecution has been obtained vide J&K Home Department Letter No. Home/Pros-Sanc/62/S/2025 dated
27.08.2025. And consequently, the charge sheet (Challan) has since been produced before the court of Special Judge designated under UAPA, Baramulla at Sopore on 01.09.2025. That being so, learned Senior counsel for the appellant, as always, fairly submits that let the appeal be disposed of with liberty to the appellant to move the trial court itself, if so advised, by filing a fresh bail application. In the wake of above and in terms of the statement made by learned counsel for the appellant, the appeal is disposed of with liberty as prayed for. Needless to assert that in the event any fresh bail application is moved, the same shall be considered, afresh and in accordance with the law, dehors the observations recorded in the impugned order dated
06.05.2025. And as expeditiously as possible.
