Quashment of proceedings initiated in the complaint bearing File No.04/2023 dated 15.02.2023 filed under Sections 379, 417, 506 IPC, against the petitioners by respondent and order dated 23.04.2023, passed by the Court of Additional Special Mobile Magistrate, Awantipora, whereby the Trial Court has taken cognizance and issued process against petitioners, is sought for on the ground that petitioner Nos.1 and 3 are having several medical morbidities and have not travelled since a long to the Kashmir and petitioner No.4 does not reside anymore in India since the year 2018; that the Trial Court has not observed the true interpretation, meaning and scope of Section 202 Cr.PC as the police report submitted by SHO concerned does not reveal any single fact which would have raised the judicial wisdom of the Trial Court to the extent of issuing process against the petitioners. 2. None has appeared on behalf of petitioners on the day first when this petition has been instituted. However, on 31.05.2024, proxy counsel for the petitioners has appeared and sought adjournment and the matter was adjourned and posted to 05.06.2024. Again on 05.06.2024, the matter was adjourned at the request of proxy counsel for the petitioners. On previous date, none has appeared on behalf of petitioners; same is the position today as well. Even notice has not been issued in this matter. It seems that the petitioners have lost interest in prosecuting the matter. 3. In view of above, the present petition is dismissed for want of prosecution along with connected CM(S).
