VYAS Date : 09/12/2025 ORAL ORDER (PER : HONOURABLE MR.JUSTICE N.S.SANJAY GOWDA) 1. Rajput Mahendrasinh Roopsinh has filed this petition contending that Tanviben @ Janviben D/o. Jagdishbhai Bhikhabhai with whom he had married has been confined by her father i.e. fourth respondent. 2. On being ordered, the State has secured the presence of Tanviben @ Janviben, fifth respondent, and present her before us. Tanviben @ Janviben D/o. Jagdishbhai Bhikhabhai submits that she is living with her parents and does not want to live with the petitioner. She does not accept any of the contention advanced by the petitioner. 3. Tanviben @ Janviben D/o. Jagdishbhai Bhikhabhai also submits that she aged 22 years and this fact is not disputed by the petitioner or his counsel. Since Tanviben @ Janviben is aged 22 years, it is obvious that she has legal right to stay at a place of her choice and with the person of R/SCR.A/15358/2025 ORDER DATED: 09/12/2025 her choice. Since she categorically states that she wants to stay with her parents, it is obvious to note that she is not in any kind of illegal confinement. This petition is, therefore, closed.
