Learned counsel for the applicant submits that due to inadvertence the prayer has been wrongly mentioned. Learned counsel for the applicant is permitted to correct the same during the course of hearing. Sri Akhil Tripathi, learned counsel for the applicant and Sri Karunakar Singh, learned A.G.A. for the State are present. The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Execution Case No. 30 of 2023, arising out of an application under Section 128 of Cr.P.C. to quash the order dated 23.03.2023 passed by Additional Principal Judge, Family Court, Court No. 4, Allahabad in Maintenance Case No. 551 of 2018, whereby the application under Section 125 of Cr.P.C. has been allowed partly. Learned counsel for the applicant fairly admits that a criminal revision against the order dated 23.03.2023 has been dismissed by co-ordinate Bench of this Court. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
