4. Petitioner participated in a selection for the post of Foreman Instructor held by Uttarakhand Public Service Commission. Petitioner was declared successful in the written examination. The selecting body issued an Office Memorandum on 27.05.2025 requiring all the candidates to produce the certificate indicating that the institute where the candidate concerned has served and obtained experience certificate, is registered with any Government Agency and fifteen days time was given to each candidate for this purpose.
5. Petitioner challenged the said Office Memorandum on the ground that the rules of the game cannot be changed midway, as earlier there was no such condition mentioned in the advertisement.
6. A coordinate Bench vide an order dated 10.06.2025 directed for extending the fifteen days period mentioned in the Office Memorandum dated 27.05.2025 to
2025:UHC:8258 thirty days.
7. Mr. Pankaj Miglani, learned counsel appearing for the Selecting Body submits that in terms of the
order dated 10.06.2025 passed by coordinate Bench, the time available to all candidates was increased from fifteen days to thirty days vide notification dated 18.06.2025. By referring to averment made in paragraph no. 9 of the counter affidavit filed on behalf of respondent no. 2, Mr. Miglani submits that petitioner along with other candidates have already submitted the document in support of their claim for experience.
8. Since the time, originally granted by Selecting Body was extended by coordinate Bench and petitioner has also furnished the requisite document in the office of Selecting Body, as stated in paragraph no. 9 of the counter affidavit, the relief as claimed in this petition do not survive.
9. Accordingly, the writ petition is dismissed as infructuous.
