CRM-M-67762-2025 1 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 101 CRM-M-67762-2025 Decided on: 08.07.2026 SWARAN SINGH ALIAS SWRAN SINGH ALIAS SONU …...Petitioner Versus STATE OF PUNJAB …...Respondent
CORAM:
HON'BLE MR. JUSTICE SANJAY VASHISTH Present: Mr. Shakti Mehta, Advocate, for the petitioner. Mr. Neeraj Madaan, Sr. DAG, Punjab. **** SANJAY VASHISTH, J.
1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name & age of Petitioner (s) FIR No. Date Section(s) Police Station District Swaran Singh @ Swran Singh @ Sonu, aged about 35 years 0232 25.10.2025 109, 115(2), 191(3), 190 of BNS and Section 25 of Arms Act Sadar Kapurthala Kapurthala
2. On 02.12.2025, following order was passed:-

Learned counsel for the petitioner inter alia contends, that FIR in question has been lodged by the injured-complainant Rinku, who has described two LAVISHA 2026.07.08 18:23 I attest to the accuracy and integrity of this document PHHC, Chandigarh
CRM-M-67762-2025 2 separate incidents occurring on 24.10.2025. In the first incident, alleged to have taken place at about 10–11 a.m., complainant named Ajay Gola, his brother Vijay, Sunny Saga, Sanam Thapar @ Ghoda, Deepu DJ Wala, Pawan Banwala and Sonu @ Sultanpur Lodhi (petitioner herein) as assailants. However, even as per the complainant’s own narration, only specific role attributed in this incident is to accused Sunny Saga, who is stated to have fired a shot with the pistol in his possession. The second incident is stated to have occurred at about 11:15 p.m., when complainant Rinku along with Karanvir Singh @ Karni, Nirmal Singh @ Gora, Arman, Gurvinder Singh and Saran was having a meal at Mattu Dhaba in connection with a birthday celebration. At that time, the same set of accused persons, namely Ajay Gola, Vijay, Sanam Thapar @ Ghoda, Sunny Saga, Deepu DJ Wala, Pawan Banwala and Sonu (petitioner herein), allegedly reached the spot along with 7–8 unidentified young men. It is alleged that petitioner, armed with dattar, inflicted a blow on the back of the injured, which has subsequently been opined to be a simple injury. The main role, however, is attributed to co- accused Ajay Gola and Sunny Saga. 3. Further submits that petitioner has been falsely implicated in the case, which can be verified by examining the CCTV footage of the cloth shop where the petitioner was working continuously from morning till evening. Once the petitioner is found to have been falsely named in the morning incident between 10–11 a.m., allegations regarding the evening incident, where again several persons have been named including the petitioner, would also be rendered doubtful and appear to be a concocted version. It is argued that since the injury attributed to the petitioner is simple in nature, custodial interrogation is not required. However, petitioner is willing to join the investigation and fully cooperate, provided protection from arrest is granted. Thus, counsel prays that petitioner be extended the concession of anticipatory bail in the present case. 4. Notice of motion. 5. On advance notice, Mr. Neeraj Madaan, Sr.

6. Adjourned to 17.02.2026, to enable learned State counsel to file status report in the matter, after examining the CCTV footage and incorporating its gist in the said report. 7. Meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.). 8. Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport. It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court.”
3. Continuing his submissions, learned counsel for the petitioner contends that in compliance of the order dated 02.12.2025, passed by this Court, petitioner has joined the investigation, and has fully co-operated. Therefore, he prays for confirmation of the said interim anticipatory bail order. 4. Learned State counsel, confirms the said averment made by counsel for the petitioner of joining the investigation by the petitioner. 5. Heard learned counsel for the parties. 6. Insofar as the offence under Section 115(2) of Bharatiya Nyaya Sanhita (BNS) is concerned, status report dated 30.06.2026, already filed by the State, reflects the injuries sustained by the complainant and the injured persons. All the injuries have been opined to be simple in nature and if, considered in isolation, would constitute a bailable offence.

However, petitioner shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023. 8. Accordingly, petition stands disposed of.
