2 THIS MISCELLANEOUS FIRST APPEAL IS FILED U/S.173(1) OF MV ACT PRAYING TO MODIFY THE JUDGMENT AND AWARD DATED 07.10.2022 PASSED IN MVC NO.26/2011 ON THE FILE OF THE SENIOR CIVIL JUDGE AND MACT, MALAVALLI, PARTLY ALLOWING THE CLAIM PETITION FOR COMPENSATION AND SEEKING ENHANCEMENT FOR COMPENSATION. THIS MISCELLANEOUS FIRST APPEAL COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
CONCILIATION ORDER Learned Counsel appearing for the appellant and learned Counsel appearing for the respondent–Insurance Company along with its representative are present. 2. After negotiation, the matter is settled. A joint memo signed by learned Counsel appearing for the appellant (being authorized by the appellant to sign) and learned Counsel appearing for the respondent-Insurance Company and its authorized officer is filed. The appellant has agreed to receive and the respondent -Insurance Company has agreed to pay a lump-sum of Rs.1,60,000/- (Rupees One Lakh Sixty Thousand only), in addition to what has been awarded by the Tribunal, in full and final settlement of the claim. 3. It is noticed that claimant No.1/mother of the deceased died pending proceeding. She was survived by claimant No.2/her daughter and present appellant/her

3 granddaughter. Therefore share of claimant No.1 devolves upon claimant No.2 and present appellant. 4. The respondent-Insurance Company has agreed to deposit the said amount before the Tribunal within six weeks from the date of preparation of award, failing which the said amount shall carry interest at the rate of 9% P.A. from the date of default, till the date of deposit.
On such deposit, 75% of the amount shall be digitally released to respondent No.3/appellant and 25% of the amount shall be digitally released to claimant No.2. 5. The apportionment, release and investment of the enhanced compensation amount in Fixed Deposit shall be in terms of the judgment and award passed by the Tribunal. 6. The appeal stands disposed of in terms of the joint Memo. The impugned judgment and award of the Tribunal shall stand modified accordingly. Draw award accordingly. Sd/- JUDGE
