Neutral Citation No. - 2025:AHC:115315 Court No. - 4 Case :- WRIT - A No. - 9705 of 2025 Petitioner :- Ajay Kumar Pandey Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Ajeet Kumar Shukla,Sarvesh Kant Shukla Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Ajeet Kumar Shukla, learned counsel for the petitioner and learned Standing Counsel for the State respondents. By means of this petition filed under Article 226 of the Constitution, petitioner has challenged the order dated 11th June, 2025, whereby order has been passed to adjust the excess amount paid to the petitioner towards leave encashment.
Learned counsel for the petitioner submits that order for adjustment dated 11th June, 2025 has been passed without any notice and opportunity of hearing. From the perusal of the order it transpires that the petitioner was not served with the notice prior to passing of the order dated 11th June, 2025 and straightaway adjustment has been directed to be done claiming that the excess payment was made to the petitioner. Upon a pointed query being made learned Standing Counsel could not demonstrate from the order as to whether petitioner was served with any notice much less a show cause notice prior to passing of the order dated 11th June, 2025. In view of the above, I consider it appropriate, at this stage, to dispose of this petition with a direction to the petitioner to furnish his reply taking the order dated 11th June, 2025 as a notice within a period of four weeks and in the event if he does so, the concerned authority, namely Senior Superintendent of Police, Azamgarh shall decide the matter of excess payment of the petitioner considering the reply within a further period of one month.
The order dated 11th June, 2025 shall abide by the result of decision to be taken by the authority as directed herein above.
