This appeal is directed against the order dated 29.01.2025 passed in A.B.P. No. 1822 of 2024 arising out of Bengabad P. S. Case No. 153 of 2023 by the learned Additional Sessions Judge V, Giridih whereby and whereunder the prayer for anticipatory bail of the appellant has been rejected. It has been alleged that a raid was conducted in an illegal mining site being run in the land of Md. Abdul Quadir and one person namely, Ashok Sahu was apprehended who disclosed the involvement of the present appellant as well as of Md. Halim in running the illegal mines. So far as Md. Halim is concerned, he has been granted bail by this court in Cr. Appeal (D.B.) No. 620 of 2024. There does not appear to be any other material save and except the disclosure statement of Ashok Sahu implicating the present appellant as well as Md. Halim. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the appellant. On consideration of the aforesaid fact, we while setting aside the order dated 29.01.2025 passed in A.B.P. No. 1822 of 2024, direct the appellant above named to surrender in the court below within four -2- weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Giridih in connection with Bengabad P. S. Case No. 153 of 2023, subject to the conditions as laid down under 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This appeal is allowed. (Rongon Mukhopadhyay, J.) (Ambuj Nath, J.) R.
