HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 24334 of 2025 Court No. - 66 HON'BLE ASHUTOSH SRIVASTAVA, J. Supplementary affidavit filed today by learned counsel for the applicant is taken on record. Heard learned counsel for the applicant and Shri Purshottam Maurya, learned A.G.A for the State of U.P. and perused the record. The present bail application has been filed on behalf of the applicant- Sadab @ Sonu in Case Crime No. 345 of 2024, under Sections 103 (1), 3(5) and 61 (2) (ka) B.N.S., Police Station-Nagal, District-Saharanpur, with the prayer to enlarge him on bail. Learned counsel for the applicant submits that the applicant is innocent. He has been falsely implicated in the present case and is languishing in jail since 13.11.2024. Learned counsel for the applicant submits that similarly circumstanced co-accused Amir has already been enlarged on bail by a coordinate Bench of this Court on 20.05.2025 in Criminal Misc. Bail Application No. 13345 of 2025. Criminal history of one case has been explained in the affidavit filed in support of bail application and there is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for. Learned A.G.A. has opposed the prayer for grant of bail to the applicant but has fairly conceded that similarly situated co-accused has already been granted bail. Considering all above facts and circumstances, the nature of accusations, severity of the punishment in the case of conviction and nature of supporting evidence, reasonable apprehension of tampering with the witness and prima facie case, but without commenting on merit of case, a case for bail is made out. Accordingly, the bail application is allowed. Versus Counsel for Applicant(s) : Prakash Chandra Srivastava, Sushil Kumar Pandey Counsel for Opposite Party(s) : G.A.
