Petitioners took a loan from Punjab & Sind Bank, however, they could not repay the loan in time, the bank filed Original Application No. 267 of 2020 under Section 19(1) of Recovery of Debts and Bankruptcy Act, 1993, which was allowed and recovery certificate was issued against petitioners, on 27.09.2022. 4. In this writ petition, petitioners have sought the following reliefs:- “I. a writ, or order or direction in the nature of mandamus directing the respondent Bank to consider the case of petitioner for OTS scheme as per the guidelines of RBI in a time bound manner. II. A writ order or direction in the nature of Certiorari quashing the notice for settling a sale proclamation dated 25-04- 2025. (Annexure no-4 to the writ petition).” 5. Learned counsel for petitioners submits that petitioners are ready to enter into one time settlement with the bank and they be permitted to make an offer for the said purpose to the Competent Authority in the bank. 6. Learned counsel appearing for the bank submits that if petitioners are serious about one time settlement then they may make a reasonable offer to the bank and the Competent Authority shall examine the issue and take decision as per law. 7. The writ petition is, accordingly, disposed of with liberty to petitioners to make proposal for one time settlement to the Competent Authority. Petitioners shall tender a sum of `10,00,000/- (Ten Lacs Rupees only), along with the proposal, to be submitted. If petitioners submit such proposal within one week from today, the Competent Authority shall consider their request and take decision, as per law, within three weeks from the date of its receipt. 8. Let a certified copy of this order be issued today itself.
