1. Petitioners seek quashing of FIR No. 0139 dated 23.09.2024 under Sections 452, 441, 405, 503 Indian Penal Code, Police Station City Gurdaspur, District Gurdaspur and all subsequent proceedings arising therefrom, on the basis of compromise 30.09.2025. 2. On 12.01.2026, this Court directed the parties to appear before the trial Court/Illaqa Magistrate for recording of their statements with regard to compromise. 3. In compliance of the order dated 12.01.2026, parties appeared before learned Chief Judicial Magistrate, Gurdaspur on 09.02.2026. Statement of the Investigating Officer, ASI Jagjit Singh No. 288/Gsp, posted at Police Station City Gurdaspur was recorded on 12.02.2026. 1. The number of accused arraigned in the FIR and how many have appeared before it and have made statements and whether any accused is absconding/proclaimed offender, in the case. There are total four accused arraigned in the FIR and out of four, three accused namely Jasbir Singh, Manpreet Kaur and Ajmeet Singh have appeared before this Court and have made statements. As per the statement of IO/ASI Jagjit Singh, accused namely, Taranjot Singh son of Jasbir Singh resident of 92/8 Batala Road, near Vishal mega Mart, Dashmesh Nagar, Gurdaspur has already been died. Also, as per the statement of IO/ASI Jagjit Singh, accused persons/petitioners are not declared proclaimed offender in this FIR. 2. The number of complainant and injured/aggrieved and whether all of them have appeared and made their statements in support of the compromise. The name of complainant is Amar Singh son of Gurmej Singh resident of Makhan No. 447/14, New Sant Nagar, Ice Factory wali Gali, Gurdaspur, Tehsil and District Gurdaspur and he has appeared to make his statement in support of compromise. 3.
The stage of trial/proceedings pending. As per the report of Ahalmad, challan in the present FIR has not been presented in the Court so far. 4. As per the statement of IO/ASI Jagjit Singh, no accused/petitioners are involved in any other case. 4. Learned State counsel and learned counsel for respondent No. 2 have not raised any dispute regarding the factum of compromise. Since the matter has been amicably resolved, continuation of the criminal proceedings would be an exercise in futility. 5. Following principles of law laid down by the Full Bench Judgment of this Court in “Kulwinder Singh and others Vs. State of Punjab and another” 2007(3) RCR (Criminal) 1052 and Hon’ble Supreme Court in “Gian Singh Versus State of Punjab and others” (2012) 10 SCC 303, the petition is allowed. 6. FIR No. 0139 dated 23.09.2024 under Sections 452, 441, 405, 503 Indian Penal Code, Police Station City Gurdaspur, District Gurdaspur with all the subsequent proceedings arising therefrom, is quashed qua the petitioners. 7.
