(Oral) Petitioner herein, who is working as a Driver in the respondent-Board, is aggrieved of order dated 18.11.2024, issued under the signatures of Executive Engineer (Pers.), HPSEBL, Vidyut Bhawan, Shimla, whereby he has been ordered to be transferred from Electrical Division, Rampur to Electrical Division, Rohru.

It is not in dispute that petitioner has already completed his normal tenure of posting at Electrical Division, Rampur and as such, there appears to be no justification for this Court to interfere with the impugned order of transfer, however, having taking note of the communication dated 23.11.2024, issued under the signatures of Superintending Engineer, Operation Circle, HPSEBL, Rampur Bushahr (Annexure P-3), whereby afore authority requested Chief Engineer (OP), Shimla Zone, HPSEBL, Vidyut Bhawan, Shimla, for
2025:HHC:3433 2 cancellation of transfer of the petitioner for smooth plying of vehicles under the control of Senior Executive Engineer, Electrical Division, HPSEBL, Rampur Bushahr, this Court without going into the merits of the case, deems it fit to dispose of the present petition with a direction to Chief Engineer (OP), Shimla Zone, HPSEBL, Vidyut Bhawan, Shimla, to consider the representation filed by the petitioner, which has been already forwarded to afore authority vide communication dated 23.11.2024 (Annexure P-3), expeditiously, preferably, within a period of two weeks. Ordered accordingly.
3. Till the disposal of the representation filed by the petitioner, as detailed in communication dated 23.11.2024 (Annexure P-3), he shall not be compelled to join at the transfer station. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass detailed speaking order thereupon. Liberty is reserved to the petitioner to file appropriate proceedings in the appropriate Court of law, if he still remains aggrieved. Pending applications, if any, also stand disposed of.
