ORAL ORDER
The petitioner asserts that he has successfully executed the work entrusted under the Work Order dated 23.06.2008 and as part of the work entrusted he has also ensured due maintenance for four years after completion. The petitioner further asserts that though he could not ensure maintenance work for the fifth year because of ill health, he has completed the maintenance later but he has not been paid the dues for such work [the cost of the work payable for the maintenance in the fifth year].

The petitioner has approached this Court for a direction to consider his representation for payment in the writ petition in W.P. No.2323/2020, which stands disposed of by order dated 23.09.2022 directing the second respondent, M/s. Karnataka Rural Road Development Agency to process the petitioner’s request. The second respondent’s impugned order as per Annexure-G is after this direction. The second respondent, while observing that the petitioner has not completed the maintenance work within the time schedule, has observed that the relevant package comprising this work has been made over to the Assistant Executive Engineer, PWD, Inland Waters Department on 15.04.2015 and the fifth year maintenance work has been cancelled way back in the year 2018. This Court, in view of the reasons assigned steeped in factual matrix, is not persuaded to interfere under Article 226 of the
