The petitioner is before this Court seeking for the following reliefs: "WHEREFORE the petitioner most humbly prays that this Hon'ble court be pleased to: a) call for the relevant records; b) Issue a writ of mandamus directing respondent-2 to consider the representation given by the proprietrix of the petitioner company dated 5/7/2022, 5/6/2023, 6/2/2024, 11/6/2025 and produced at ANNEXURES-F, G, H, and J respectively and direct the respondent-2 to allot a plot number to the petitioner company; c) Issue a writ of mandamus directing the respondent- 2 authorities to allot an alternate plot to the petitioner company in the same industrial area, i.e. Devanahalli, Bangalore Rural, if the original allotment of 1 acre allotted to the petitioner company at Haraluru- Muddenahalli-Hitech defence and Aerospace Park Phase-2, Devanahalli, Bangalore rural is not available anymore; d) Grant such other relief, order or direction to the respondent in the circumstances of the case, in the interest of justice and equity". 2. The petitioner being a Proprietary Concern applied for an allotment of the plot in Haraluru-Muddenahalli Industrial Area, Devanahalli Taluk, Bengaluru Rural District, under SC/ST category. The application filed by the petitioner on 07.12.2021 was considered by - 4 - HC-KAR NC: 2025:KHC:47699 WP No. 24753 of 2025 the 126th State Level Single Window Clearance Committee and 01 acre of land was directed to be allotted to the petitioner. The total cost of land being ₹2,98,00,000/- per acre, the petitioner was stated to be eligible for 75% subsidy and was required to make payment of initial 10% of total cost of ₹29,85,200/- within 30 days of the receipt of the letter which was so deposited on 31.03.2022. Despite the said payment, the plot was not allotted to the petitioner and as such, the petitioner submitted representation on 05.12.2022, 05.06.2023 and on 06.02.2024 which were not considered by the respondents. In that background the petitioner is before this Court seeking for the aforesaid reliefs. 3. The application of the petitioner having been considered by the State Level Single Window Clearance Committee and a direction has been issued to the KIADB to allot a plot of 01 acre. But it was required for the KIADB to consider the said - 5 - HC-KAR NC: 2025:KHC:47699 WP No. 24753 of 2025 recommendation and do the needful. The recommendation has been made on 09.11.2021. No plot has been allotted to the petitioner till date. 4. In that view of the matter, I pass the following: ORDER (i) Writ petition is allowed. (ii) A mandamus is issued directing the respondents to consider the representation of the petitioner dated 05.07.2022, 05.06.2023, 06.02.2024 and on 11.06.2025 in terms of the recommendation made by the 126th State Level Single Window Clearance Committee on 09.11.2021 and allot a plot to the petitioner measuring 01 acre in Haraluru- Muddenahalli High Tech Defence and Aerospace Park, Phase 2, Devanahalli, Bengaluru Rural District, within a period of six (6) weeks from date of receipt of a copy of this order. (iii) In the unlikely event of the plot of the said dimension is not available, it would be for the KIADB - 6 - HC-KAR NC: 2025:KHC:47699 WP No. 24753 of 2025 to allot a similar plot of similar dimension as close to the Haraluru- Muddenahalli High Tech Defence and Aerospace Park as available with the KIADB within the time period.
