By way of this petition, the petitioner has prayed for following reliefs:- “(i) To kindly direct the respondent to follow the circular/notification issued time to time by respondent department dated 17.06.2013, 20.02.2014 and 14.11.2019 by G.A.D for the recruitment process (For post Hostel Superintendent Grad-'D'), 2024 in its true spirit. (ii) To kindly direct the respondent no. 3 to prepare fresh final Document verification list on the basis of category in which the candidate has appeared in the examination and applied for the said post and belonging to PVTG category and consider the petitioner and further to give appointment on said post of Hostel Superintendent-'D'. (iii) To kindly direct the respondent Commissioner, Schedule Caste and Schedule Tribe Development Department Raipur, Chhattisgarh to appoint the petitioner to the post of Hostel superintendent Grad-'D'. (iv) To kindly grant any other relief which seems just and 3 fair in the eyes of law. An affidavit in support of this writ petition is filed herewith.” 2. Learned counsel for the petitioner submits that an advertisement was issued by the respondent no. 3 vide Advertisement number Vyapam/2024/0478 dated 01.03.2024 for the post of Hostel Superintendent (Grade D) for Hostels run under the respondent No. 3 Department. On perusal of the advertisement, it would be evident that total 300 posts were advertised, out of which 87 were reserved for Scheduled Tribe and 34 for only Woman candidate belonging to Scheduled Tribe and also have a Chhattisgarh Domicile Certificate and 29 for Scheduled Tribe (backlog) apart from posts reserved for female domicile residents of State of Chhattisgarh and Ex-serviceman. Therefore, a total of 150 posts were reserved for Scheduled Tribe. The petitioner has filled its application form on 15.03.2024 for the post of Hostel Superintendent (Grade-D), the petitioner is in possession of the requisite educational qualifications as prescribed by the respondents in the advertisement, namely Higher Secondary Certificate and preferential qualification i.e. computer training he was also belonging to Korwa (Pahari Korwa) Tribe which has been recognized by the State of Chhattisgarh as Particularly Vulnerable Tribal Group Category. He submits that similar identical petitions have also been decided in light of the said 4 circular and appointment orders have been issued to the similar situated candidates. He also submits that the petitioners may be given liberty to file a representation raising all his grievances before the concerned respondent authority to consider and decide his claim within stipulated time. 3. Learned counsel appearing for the State does not opposes the said submission. 4. Considering the submissions made by the parties, and further considering the aforesaid aspect of the matter, the petitioner is granted liberty to file a representation raising all his grievances before the authorities concerned within a period of ten days from the date of copy of this order and, in turn, the authorities concerned is directed to consider and decide the said representation of the petitioner while passing appropriate order in a pragmatic manner within a period of 15 days from the date of receipt of such representation, in accordance with law. 5.
