This is an application seeking condonation of delay of 22 days in preferring the appeal. Heard. For the reasons stated in the application, same is allowed and delay of 22 days in preferring the appeal is condoned. Main case
1. It is claimants’ appeal seeking enhancement in the compensation amount. On account of death of their son namely, Yogesh, the appellants had filed claim petition bearing MACP-52-2022 which was disposed of on 22.01.2025. along with other connected petitions by learned Motor Accidents Claims Tribunal, Rewari (for short – ‘MACT’). The appellants were allowed compensation of Rs.15,14,760/- payable by the respondents along with interest.

The only ground for seeking enhancement is that nothing has been awarded under the head of loss of parental consortium to the appellants.

3. Notice of motion on the aforesaid aspect.
4. Mr. Lalit Garg, Advocate accepts notice on behalf of respondent No.3- Insurance Company and submits that he has no objection if the amount under aforesaid head which is otherwise permissible under law be awarded to the appellants and the award amount may be enhanced accordingly.
5. In view of the aforesaid contentions, the present appeal is hereby accepted. It is directed that over and above the amount already awarded by the Tribunal, the appellants are also entitled to an amount of Rs.96,000/- i.e., Rs.48,000/- per claimant under the head of loss of parental consortium, which shall be payable to them along with interest @ 7.5% per annum from the date of filing of the claim petition till the next date of actual payment.
