Learned counsel for the petitioner submits that he has received the instruction that this order which the petitioner is challenging before this Court is appealable as there is remedy of statutory appeal.

He wants to withdraw this writ petition with a liberty to file a departmental appeal before the Appellate Authority.

Prayer is allowed.

This writ petition is dismissed as withdrawn.

The liberty is given to the petitioner to file a departmental appeal within four weeks. If this appeal is filed, the same should be considered and
disposed of on merits by the Appellate Authority within a period of six months from the receipt of the copy of the order.
