The order dated 28.05.2025 passed by the respondent No.3/Sub Divisional Officer, Nawabganj, Bareilly is under challenge by which fair price shop license has been cancelled. 2. Today when the matter is taken up, a preliminary objection has been taken by the learned Standing Counsel that against the order of cancellation of fair price shop, statutory alternative remedy is available to the petitioner to file appeal before the Appellate Authority as provided under Section 13(1) of U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016. 3. In this view of the matter, the present petition is dismissed on the ground of availability of statutory alternative remedy.
