Neutral Citation No. - 2025:AHC:114319 Court No. - 4 Case :- WRIT - A No. - 9622 of 2025 Petitioner :- Amar Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Jai Kishan,Vipin Kumar Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Jai Kishan, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for a writ of certiorari for quashing the order dated 18.03.2025. Learned Standing Counsel on the contrary obtained instructions in the matter and as per instructions petitioner has been implicated in criminal case being case crime no. 039 of 2025, under Section 190, 191(2), 115(2), 351(2), 352, 109, 132, 121(2), 324 B.N.S. and hence he has been issued with show cause notice. It is further argued that writ petition against a show cause notice is not entertainable at this stage as the petitioner has an opportunity to put up his defence by means of explanation to the show cause notice. However, it is not averse that the matter of show cause notice being directed to be disposed of expeditiously in a time bound period. In view of the above, while I decline to grant indulgence in the matter of show cause notice at this stage, I hereby provide that in the event petitioner approaches the authority concerned by filing the reply to the show cause notice within a maximum period of four weeks from today, the authority concerned shall then proceed to decide the matter of show cause notice within a further period of two months. In view of the above, this petition stands disposed of with the aforesaid observations and directions. Needless to add the order to be passed by the competent authority, as directed herein above, shall be reasoned and speaking one.
