This is a petition under Article 226 of the Constitution of India for seeking the following relief(s): i. Admit this petition. ii. Call for the records from the custody of the respondents. iii. Issue notice upon the respondents. And iv. After hearing the parties be pleased to direct the state respondents for providing pension w.e.f. 01.05.2021 along with interest to the petitioner as he was an employee as a Group-D post under the control of the respondents above 10 years. It is the case of the petitioner that the petitioner was engaged by the State respondents in the post of Group-D (DRW) on 21/10/1996 and he was regularized on 1/7/2008 by the respondents. Thereafter the petitioner constantly discharged his duty with utmost satisfaction of the authority as well as public in general without any stigma at any point of time. Thereafter, after completion of his service, the state respondent further extended his work/engagement further period of 3 (three) months i.e. till 30/04/2021. Accordingly, on 30/04/2021 the respondents released the petitioner from the Govt. service in the afternoon on 30/04/2021 on superannuation beyond the age of 60 years service. Thereafter the petitioner though so many occasion approached the respondent for providing pension in his favour but most unfortunately the respondent did not provide any pension to the petitioner. The petitioner thereafter issued a Notice to the respondents through his engaged lawyer for providing pension then Deputy General Manager, Electrical Sub- Division, Kanchanpur by giving a reply stated that the matter will be provided through the Executive Engineer, GPF & Pension Cell, West Tripura, Agartala but when the petitioner physically met with said person then he also vehemently denied to provide the pension, finding no other alternative the petitioner filed this writ petition. On perusal of the record, it is seen that the respondents had intimated the petitioner by the communication dated 30.10.2024 that the retirement pension will be provided by the Power Department, through the Executive Engineer, GPF & Pension Cell, West District Tripura, Agartala. In view of above submission, without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the respondents to consider the case of the petitioner in the light of the communication dated 30.10.2024 in accordance with law within a period of three months from the date of receipt of copy of this order. With the above observation and direction, this present writ petition stands disposed of. As a sequel, stay, if any, stands vacated. Pending application(s), if any, also stands closed.
