JUSTICE A.GUNESHWAR SHARMA 13.3.2025 Present Mr.P.Tomcha, learned counsel for the applicant, Mr.O.Ratankumar, learned counsel and Mr.Bheigya, learned counsel appearing on behalf of the State respondents Nos.1-3, Mr.N.Ibotombi, learned senior counsel Mr.Leo, learnd counsel for respondent No.4, Mr.H.Dijen, learned counsel appearing on behalf of respondent No.5, Mr.W.Harendra appearing in person and Mr.Kh.Mani, learned senor counsel assisted by Mr.Gautam Sharma, learned counsel for respondent Nos.7 to 9. Vide order dated 21.1.2025 passed in WP(C) No.859 of 2024, this Court passed order disposing the writ petition in the following terms: “(I) The last General Body Meeting, adjourned due to lack of quorum, shall be called in the first week of March, 2025 by the present Office Bearers of the Executive Committee of the AMBA; (II) In the proposed General Body Meeting of the AMBA, relating to pending account; holding of fresh election and other agenda put up by the Executive Committee shall be considered. (III) The statement of account duly approved by the GBM shall be submitted to the Registrar, Society, Manipur, by the present office bearers and the same shall be treated as filed in compliance of statutory requirement. (IV) Up to 28.02.2025, membership renewal be completed for preparation of voter list. (V) Election for the Office Bearers of AMBA for the next term, shall be completed on or before 25.3.2025 so that handing over and taking over of charge to the new Office Bearers could be made before expiry of the extended term of the present Office Bearers i.e. 31.03.2025. (VI) The next term of Office Bearers will be starting from 1.4.2025 as per Rules. In terms of the above settlement, the impugned order dated 6.12.2024 passed by the Registrar of Societies, Manipur, is modified to the effect that the last elections of Office Bearers of AMBA were conducted for the year 2019 and 2022. Any formalities for submission of documents to the Office of the Registrar of Societies, Manipur, shall be done by the present Office Bearers of AMBA. In terms of the above, WP(C) No.859 of 2024 and pending applications are disposed of.” Thereafter, the All Manipur Bar Association (AMBA) filed the present MC (WP(C)) No.166 of 2025, inter alia, praying for modification of the above time-line. In terms of the order dated 21.1.2025 the General Secretary AMBA sent a letter dated 3.2.2025 to the Registrar of Societies, Manipur, for deputing an Auditor for auditing for the period 2019-2020; 2020-2021, 2021-2022; 2022-2023; 2023- 2024 and 2024 to 2025. Thereafter, office of the Joint Registrar (Audit) Cooperative Societies, Manipur sent letter dated 17.2.2025 to the General Secretary, AMBA stating that the audit of the period i.e. 2019- 2020 to 2024-2025 cannot be completed within the short period as requested. Mr.O.Ratankumar, learned Dy G.A informed this Court that the Registrar of Societies, Manipur sent a letter dated 7.3.2025 to the office of the Dy. A.G, Manipur informing that audit for the period 2019-2020 to 2024-2025 can be completed by 15th April, 2025 After perusing the materials on record and as agreed to by the parties in the Chamber, the order dated 21.1.2025 passed by this Court in WP(C) No.859 of 2024 is modified to the extent that; the Registrar of Societies, Manipur shall complete the process of audit for AMBA for the period 2019-2020 to 2024-2025 on or before 10.4.2025 and send a report to the AMBA on or before 10.4.2025. Thereafter, the present Office Bearers of the AMBA shall complete the election of Office Bearers of AMBA for the period starting from 2025 by 30.04.2025. Handing over of charge of office to the new Office Bearers be completed as per law. Renewal of membership for the purpose of preparing voter list for the ensuing election be completed by 31.3.2025. Considering the prevailing situation, those members who have already renewed for the term 2024-2025 and could not renew by 31.3.2025 shall also be eligible to be included in the voter list for the ensuing election. In terms of the above, the misc application is disposed of. Furnish a copy of this order to learned counsel for the parties.
