The counsel for the petitioners is permitted to implead the Principal Secretary (Department of Jail and Reforms), Government of Uttar Pradesh, Lucknow as respondent no. 2 during the course of the day itself. Heard the counsel for the petitioners and the A.G.A. for the State. The present petition has been filed for the following relief:- "i. Issue appropriate writ, order and direction in the nature of mandamus to directing the Respondent (Principal Secretary, Home, Government of U.P. Lucknow) to decide the Mercy Petition (Form-A) presented by the petitioners under section 2 of U.P. Prisoner Release on Probation Act, within time bound frame." The petitioners have already spent more than 20 years in jail by virtue of the judgment and conviction passed in Sessions Trial No. 208 of 2001 by the Additional Sessions Judge, Court No. 05, District Azamgarh arising out of Case Crime No. 384 of 2000 under Sections 147, 148, 149, 302 I.P.C. and 7 Criminal Law (Amendment) Act, Police Station Jahanganj, District Azamgarh and the Mercy Petition of the co-accused Vinod Yadav has already been decided by the State Government. Considering the case of the petitioners, the petition is disposed of with a direction to the Principal Secretary (Department of Jail and Reforms), Government of Uttar Pradesh, Lucknow (newly impleaded as respondent no. 2) to decide within a period of three months from the date a certified copy of this order is produced before him and pass appropriate orders in accordance with law on the Petition of the petitioners filed under Section 2 of U.P. Prisoner Release on Probation Act.
