ORAL ORDER
1. The wife of detenu Veeresh CTP 10366 is before this Court seeking for the following reliefs; a. Direct the R2 to release the petitioners husband namely Veeresh S/o Durgappa on general parole for the period of 90 days in the interest of justice.
b. Pass any other order/s which this court may deem fit and proper under the facts and circumstances of the case, in the interest of justice.
2. The detenu had been convicted for offences under Section 376 of IPC r/w Section 5(m), read with Section 6 of POCSO Act, 2012 and Section 307 of IPC r/w Section 5(r) r/w Section 6 of POCSO Act, and Section 201 of IPC and on 30.04.2018 sentenced to imprisonment for life in Special C.C.No.453/2017 by the 53rd Additional City Civil and Sessions Judge, Bengaluru. The detenu as on 17.05.2025 incarcerated for a period of 7 years, 8 months, 14 days and had been granted court parole on one earlier occasion for a period of 3 months. The detenu

has made another application for release on parole on the ground that house renovation is required to be carried out. The said application having been rejected, the present writ petition is filed seeking for the aforesaid reliefs.
3. A perusal of the papers indicates that the detenu had once earlier been released on parole and he has complied with all the conditions. There is no complaint against the detenu. His conduct during incarceration is also satisfactory. In that view of the matter, I am of the considered opinion that the detenu cannot be deprived of parole once again so as to facilitate his reintegration on release. Hence, I pass the following:
ORDER i. The writ petition is allowed. ii. Respondent No.2-the Chief Superintendent, is directed to release detenu Veeresh CTP 10366 on parole for a period of 60 days commencing from 24.11.2025, subject to the following conditions.

a) The prisoner Veeresh CTP 10366 shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take him to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of emergency parole. b) Respondent No.1 shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iii. The Registry is directed to communicate the
order to the prison Authority for its immediate execution.
