JUSTICE PRAVEER BHATNAGAR Order 27/02/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioners have been arrested in connection with FIR No.23/2025 registered at Police Station Khoh, District Deeg for the offence(s) under Sections 319(2), 318(4), 308(2), 317(2), 317(4), 338, 336(3), 340(2), 61(2)(a), 313, 303(2) and 317(5) of BNS and Section 66D of IT Act. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the matter is exclusively triable by [2025:RJ-JP:8790] (2 of 2) [CRLMB-2399/2025] Magistrate. The accused-petitioners are in custody since long and there are no criminal antecedents against the accused-petitioners, the trial/investigation of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor vehemently opposes the bail application. 4. Heard and perused the material available on record. 5. Considering the fact that the matter is exclusively triable by Magistrate and there are no criminal antecedents against the accused-petitioners, the trial/investigation of the case may take considerable time, without commenting further anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely 1. Adil S/o Nijjar, 2. Akram S/o Hanna and 3.
