BEFORE HON'BLE MR. JUSTICE ROBIN PHUKAN ORDER 14.02.2025 Heard Mr. H. Talukdar, learned counsel for the petitioner. Also heard Mr. S.S. Roy, learned CGC, appearing for the respondent No.1 and Ms. R. Bora, learned standing counsel, CBSE, appearing for the respondent Nos.2—5. Pursuant to the order of this Court dated 13.02.2025, Ms. Bora has obtained verbal instruction from the respondent Nos.2—5 and also producing a letter of Regional Officer, CBSE and some documents such as examination date sheet, submits that as per date sheet, the examination of Class-XII will commence from 15.02.2025 and at the 11 th hour, it is impossible on the part of the respondent Nos.2—5 to change the examination centre from JNV, Adalvari, Baska to Eklavya Model Residential School, Dalbari. Ms. Bora further pointed out that the distance between JNV, Adalvari, Baska and Eklavya Model Residential School, Dalbari is only 13.5 km and besides, the Principal of
Page No.# 3/3 from JNV, Adalvari, Baska has already made arrangement of ASTC buses for transportation of students during the examination days and as such, it is contended to dismiss the petition. Mr.
Talukdar, learned counsel for the petitioner at this stage submits that if ASTC buses are provided for transporting the students, then the grievance of the writ petitioner is substantially addressed and as such, this petition may be closed. Taking note of the submission of the learned counsel for both the parties and also considering the given facts and circumstances on the record especially the letter of the Regional Officer placed before this Court by Ms. Bora, learned standing counsel for the respondent Nos.2—5, this writ petition stands closed.
