Challenge in the present petition is to additional minimum eligibility criteria circulated through letter dated 13.05.2024 (Annexure P-14) with a further prayer to direct the respondents, especially respondent No.2, to declare the petitioner eligible for promotion as Professor as per the criteria mentioned in Clause 5.1 of the NIPER Statute, 2003 and to promote her alongwith all consequential benefits.
Learned Sr. Counsel for the petitioner contends that during the pendency of the present petition, the petitioner has now been served with a letter bearing No.F.1-5(8)/2024/Estt./330 dated 01.04.2025, whereby the respondents have conveyed that the case of the petitioner for CAS promotion to the post of Professor is being processed as per the existing provisions as enshrined under Clause 5.1 of NIPER Statute, 2003. It has been further informed therein that the

assessment period of the petitioner shall be 23.09.2016 to 22.09.2021 and the petitioner shall be assessed under the Old CAS criteria.
Learned Sr. Counsel for the petitioner submits that in view of the aforesaid letter, the instant petition has become infructuous at this stage.
Disposed of as having been rendered infructuous, at this stage.
