This writ petition has been filed with the following prayer:- "Issue, a writ, order or direction in the nature of mandamus commanding and directing the respondent 2, Sub Divisional Magistrate, Tehsil Milak, District Rampur to decide the application dated 5.9.2022 pend before under section 38 of U.P. Revenue Code, 2006 expeditiously within stipulated period to be fixed by this Hon'ble Court." 2. It is contended by learned counsel for the petitioner that application dated 5.9.2022 under Section 38 of U.P. Revenue Code, 2006 is pending consideration before respondent no. 2. The sole prayer made in the writ petition is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent No.2 to decide application dated 5.9.2022 under Section 38 of U.P. Revenue Code, 2006, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
