This petition under Article 227 of the Constitution of India has been filed for setting aside order dated 30.01.2025 (Annexure P-1) and order dated 11.12.2019 (Annexure P-2), whereby proclamation of sale has been drawn by the learned Executing Court, after dismissing the objections filed by the petitioner. 2. At the very outset, learned counsel for the petitioner states that although the present petition arises from execution proceedings (EXE/30/2019) for enforcement of the judgment and decree dated 16.11.2018, but in parallel proceedings, i.e. civil appeal filed against the said judgment and decree being Indiga No.3 of 2019, titled as ‘Kulwant Singh vs. Suresh Pal’, the proceedings before the Executing Court were stayed, vide order dated 29.05.2025, till the next date of hearing. It is further stated that the said appeal is still pending and stay order has been extended and continues to remain in operation till date.
