The petitioner in the present petition has impugned the order dated 7th February, 2023, whereby the private respondent has been appointed as Lambardar for the village Ahgam, Tehsil Keegam, District Shopian for a period of six moths subject to confirmation of District Collector, Shopian and has also sought a direction upon the respondent Nos. 1-3 to allow her to continue as Lambardar in his village in terms of Rule 16 (5) of the Lambardari Rules, 1980. 2. It is stated that the petitioner was appointed as Lambardar vide order dated 24th April 2011, passed by the District Collector Shopian, but without dismissing the petitioner and without conducting the general elections, the respondent No. 4 was appointed as Lambardar. The petitioner has placed reliance upon the case tiled as “Bashir Ahmad Teli v. State of J&K & ors bearing OWP No. 1809/2017”. 3. The official respondents have filed their response, stating therein that the work and conduct of the petitioner was not up to the satisfaction of the official respondents and adverse verification reports were received against the petitioner along with other Lambardars and Chowkidars and further new Lambardar has already been appointed in terms of Rule 14(4) of J&K Lambardari Rules, 1980 for a period of six months subject to necessary confirmation from the District Collector, Shopian. 4. In terms of order dated 29th May, 2023, the order impugned was stayed. The petitioner has already worked beyond the period of more than five years and this Court has already dismissed the challenge thrown to SRO 412 of 2017 in OWP 1809/2017 in case titled as Bashir Ahmad Tei v. State of J&K & Ors. 5. In view of this, no fruitful purposed would be served to retain this petition pending on board. As such, the writ petition is disposed of by directing the official respondents to conduct the elections for the position of Lambardar for the village Ahgam, Tehsil Keegam, District, Shopian within a period of three months. Till then the order dated 29th May, 2023 shall continue to remain in operation. 6. Disposed of in the above terms along with connected CM(s). Needless to mention here that the official respondents shall release the legitimately earned honorarium/wages to the petitioner as per her entitlement at an earliest.
