By way of present petition, the petitioner challenges the order dated 06.06.2023 passed by the respondent no.1/Registrar General of Money Lending and Special Registrar Co-operative Societies, M.S. Pune in Revision Application No.56 of 2021, whereby respondent no.1 allowed the revision filed by respondent no.5 partly and the matter was remanded to the District Deputy Registrar Co- operative Societies, Aurangabad to decide afresh. 3. Mr. Suryawanshi, learned counsel for the petitioner points out that when earlier notice was issued, the hearing was scheduled on 07.06.2023. But the hearing was preponed by respondent no.1 and that was kept on 03.05.2023 and before one day, the petitioner received the notice. 2025:BHC-AUG:35253 62-wp-9179-2023.odt (2) 4. Without going into the merits of the matter, once the date was already scheduled, there was no reason for respondent no.1 to prepone the date, though pursuant to the notice, the petitioner appeared. But the fact remains that once the hearing was scheduled no reason for preponement was assigned, on this ground, I am inclined to allow the petition by setting aside the order passed by respondent no.1. Hence, the following order is passed: ORDER (i) Writ Petition is allowed. (ii) The order dated 06.06.2023 passed by the respondent no.1/Registrar General of Money Lending and Special Registrar Co- operative Societies, M.S. Pune in Revision Application No.56 of 2021, is quashed and set aside. (iii) The Revision filed before respondent no.1 is restored. The parties to appear before respondent no.1 on 06.01.2026. (iv) After appearance of parties, respondent no.1 is directed to decide the proceeding within a period of three months thereafter. (v) All points kept open. (SIDDHESHWAR S. THOMBRE, J.) Mujaheed//
