2. Mr. Mohd Shafy, learned counsel for the Respondent no.2 - Uttarakhand Waqf Board.
3. The present writ petition has been filed by the Petitioner under Article 227 of the Constitution of India for the following relief (s):-
“(a) To set aside the judgement / order 29-09- 2022 passed by the learned judge of The Court of small causes case / Civil Judge (S.D) Haldwani in the S.C.C. Suit No 04/2015 (Annexure No 8) and the judgement / order dated 22-11-2023 passed by The Additional District & session Judge (First) Haldwani in the Civil Revision No. 06/2022 (Annexure No 9) and remand the S.C.C. Suit No 04/2015 to Waqf Tribunal Haldwani for hearing as fresh case.”

Learned counsel for the Petitioner makes a statement before this Court that the Petitioner may be allowed to approach the appropriate Forum, and placed an order dated 22.05.2025 passed by coordinate Bench of this Court in WPMS No.3372 of 2024.

Learned counsel for the Respondent No.2 Mr. Mohd Shafy, has made an appearance, and concedes with the statement, as has been, made by the learned counsel for the Petitioner.
6. Accordingly, the present writ petition is disposed of in light of the order dated 22.05.2025 passed in WPMS No.3372 of 2024, and the petitioner is at liberty to approach the appropriate Forum under Section 83 (1) of Wakf Act, 1995.
