Neutral Citation No. - 2025:AHC:114368 Court No. - 4 Case :- WRIT - A No. - 9629 of 2025 Petitioner :- Smt. Ranjana Devi Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Anjeet Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Anjeet Singh, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the show cause notice dated 06.06.2025 which has been issued to her to show cause as to why her appointment may not be cancelled for the reason that she had submitted false/ forged income certificate. It is submitted by learned counsel for the petitioner that no reason has been disclosed in the entire show cause notice as to how the authority has formed a prima facie view that the income certified submitted by the petitioner is forged one and hence according to him the show cause notice cannot be properly replied. However, he submits that petitioner had submitted a reply to the show cause notice on 16.06.2025 which has remained undisposed of. It is further contended that the respondent authorities are absolutely influenced by the complainant and therefore, they have issued show cause notice to somehow cancel the appointment of the petitioner as Anganbadi Worker. Learned Standing Counsel on the contrary submits that since petitioner has submitted the reply to the show cause notice, it is more appropriate that the matter of show cause notice directed to be decided in accordance with law and may be in a time bound period as this Court may directs. In view of the above, this petition stands disposed of with a direction to the District Programme Officer, Fatehpur namely the respondent no. 4 to look into and consider the reply submitted by the petitioner dated 16.06.2025 to the show cause notice dated 06.06.2025 and dispose of the same as expeditiously as possible preferably within a period of two months from the date of receipt of certified copy of this order. It is further provided that before passing any order the concerned authority shall be giving
opportunity of hearing to the petitioner as the authority has proceeded only on third party complaint. It is further provided that till the decision is taken in the matter of show cause notice, as
directed herein above, neither the petitioner will be restrained from discharging duty, nor she be denied remuneration.
