Chellappa 16.Mr. Venugopal 17.Mr. Neelakandan ..Respondents https://www.mhc.tn.gov.in/judis WP No. 39677 of 2025 __________ Page3 of 7 Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd respondent to take immediate and effective steps to remove all encroachments from the Government Poramboke lands situated in Vadanemmeli Village, Thirupporur Taluk, Chengalpattu District comprised in Survey Nos. 272/9, 276/7, 288/13, 289/1, 290/1, 290/3, 290/4, 290/14, 284/7, 301/8, 303/9, 335/1, 323/3, 305, 305/10, 331/1, 331/10, 332/1, 333/10, 337/1, 338/1, 338/3, 339/7, 306/5, 307/4, 308/2, 309/11, 309/17, 310/9, 310/12, 319/1, 320/1, 322/1, 323/2, 324/8, 326/11, 333/7, 278/14, 279/7, 279/16, 280/1, 280/12, 280/19, 281/13, 281/24, 282/12, 283/5, 291/4, 292/17, 293/19, 294/1, 296/4, and to restore them to their original condition within a time frame stipulated by this Hon’ble Court. This Writ Petition has been filed seeking a Writ of Mandamus directing the respondents to take effective steps to remove all encroachments from the lands situated at Vadanemmeli village, Thiruporur Taluk, Chengalpattu District, the survey numbers alleged to have been already mentioned in the writ petition. 2. On notice, the seventh respondent filed a counter indicating that the encroachments on the Government Poramboke land situated in Vadanemmeli https://www.mhc.tn.gov.in/judis WP No. 39677 of 2025 __________ Page4 of 7 village have been identified and most of the survey numbers mentioned in the writ petition are vacant. The counter affidavit further provides a detailed list of 55 survey numbers along with their physical status. 3. When the matter was taken up for consideration on 18.06.2026, the learned Government Advocate submitted that the temporary gate put across Survey Nos.289/1 and 290/14 by the 14th respondent to protect his patta land had already been removed. It was further alleged that despite this, the petitioner had instigated an association to erect a flex board falsely claiming that the patta land in Survey No.290/1 is encroached Government Poramboke land. Consequently, we directed the petitioner to remove the said flex board in Survey No.290/1, which was wrongly included in the notice. 4. Today, the learned Government Advocate appearing for the respondents 1 to 13, submitted that the flex board displaying Survey No.290/1 as Government Poramboke Land has been removed. 5. An additional counter affidavit has been filed by the seventh respondent stating that all encroachments on Government Poramboke land have been removed and no permanent structures have been put up or alterations made to the water channels and other land classifications in the revenue record. The seventh respondent has also given an undertaking that the Revenue Authorities https://www.mhc.tn.gov.in/judis WP No. 39677 of 2025 __________ Page5 of 7 have not granted any legal sanction or approval for any encroachment on Government land. It is further stated that wherever any encroachment is identified on Government Poramboke land, appropriate proceedings under Tamil Nadu Land Encroachment Act, 1905, will be initiated by the competent authority in accordance with law. 6. Recording the aforesaid submissions and the undertakings given by the seventh respondent, this Writ Petition stands disposed of, in view of removal of the identified encroachments on the Government Poramboke Land.
