ORAL ORDER This petition is filed by sole accused under Section 482 of Bharatiya Nyaya Sanhita, 2023 praying to grant anticipatory bail in Crime No.100/2025 of Chandrashekarpura Police Station, Gubbi, registered for offence punishable under Section 316(2) of Bharatiya Nyaya Sanhita, 2023.
2. Heard the learned counsel for petitioner and learned High Court Government Pleader for respondent - State.

Learned counsel for petitioner would contend that, whatever amount has been given to the petitioner has been recovered from the house of his relative namely Srinivas. The petitioner is ready to cooperate with the police in investigation and abide by any conditions to be imposed by this Court. The offence alleged against the petitioner is punishable with imprisonment which may extend to seven (7) years. There are no criminal antecedents of the petitioner. With these, he prayed to allow the petition.
4. Per contra, learned High Court Government Pleader would contend that, out of Rs.23,50,000/-, only Rs.20,50,000/- has been recovered from one Srinivas who is a relative of the petitioner. The petitioner has left his car in front of a house and went away. The car belonging to the petitioner has been seized. The petitioner is required for custodial interrogation. With these, she prayed for dismissal of the petition.

5. Having heard the learned counsels appearing for parties, the Court has perused the FIR, complaint and other materials placed on record.
6. The accusation against the petitioner is that, occasionally he was working as a car driver under the first informant. The first informant for making payment to the customers has
directed the petitioner to bring Rs.23,50,000/- from his father. The father of the first informant handed over the cash of Rs.23,50,000/- to the petitioner. The petitioner absconded with the said cash. Out of the said amount, Rs.20,50,000/- has been recovered from one Srinivas who is a relative of the petitioner. The remaining amount of Rs.3,00,000/- is yet to be recovered. The investigation is in progress. The car of the petitioner has also been seized which is Kept in front of a house. The offence alleged against the petitioner is provided with punishment which may extend to seven (7) years. The petitioner is not having any criminal antecedents. The petitioner has undertaken to cooperate

with the police in the investigation and abide by any conditions to be imposed by this Court.
7. Considering all the above aspects, the petitioner has made out a case for grant of anticipatory bail with conditions. In the result, the following;
ORDER The Criminal Petition is allowed. The petitioner is granted anticipatory bail in Crime No.100/2025 of Chandrashekarpura Police Station, Gubbi and is ordered to be released on bail in the event his arrest, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the Investigating Officer. ii) The petitioner shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond and furnish surety.

iii) The petitioner shall cooperate with the Investigating Officer in investigation. iv) The petitioner shall appear before the Investigating Officer whenever called for. v) The petitioner shall not directly or indirectly make any inducement of threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court or to any Police Officer or tamper with the evidence. vi) The petitioner shall appear before the trial Court on all dates hearing unless exempted and cooperate for speedy disposal of the case.
