This writ petition has been filed with the following prayer; "Issue a writ, order or direction in the nature of mandamus commanding the respondent No.2/ Sub-Divisional Magistrate, Tehsil Kasya, District Kushinagar to decide the recall application dated 30.05.2022 filed by petitioner in Case No. 5051 of 2021, Computerized Case No. T202105440405051 (Suresh Versus Narendra and another), under Section 116 of Uttar Pradesh Revenue Code, 2006 within stipulated period." 2. It is contended that a recall application dated 30.5.2022 in Case No. 5051 of 2021 (Computerized Case No. T-202105440405051) is pending consideration before the respondent No. 2. The sole prayer made in the writ petition is to expedite the aforesaid application. 3. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent No.2 to decide the recall application dated 30.5.2022 in Case No. 5051 of 2021 (Computerized Case No. T-202105440405051), in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid direction, present writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the case on merit.
