2. Petitioners, who are hostel superintendents and junior clerks serving in private aided Aashram schools, are seeking the benefit of Revised Assured Career Progression Scheme, issued from time to time and available to the teaching and non-teaching employees of the government-run Aashram schools.
3. The issue is no longer integra and stands squarely covered by the decision in the matter of Kiran Namdeo Shinde and Ors. v/s. The State of Maharashtra and Ors.: in WP No. 2358 of 2013, decided on 21.09.2013 (the Principal Seat). 1/2 2025:BHC-AUG:3703-DB

The petition is allowed in terms of prayer clauses ‘B’ & ‘C’, which reads as under :- B) To direct the respondent no.3 to grant the 1st, 2nd & 3rd benefits of the Revised Assured Career Progression Scheme to the petitioners on account of completion of 10/20/30 years of their services in the same pay bands which are granted to their counterparts of Government Tribal Ashram Schools in the light of the Government Resolution dated 02.03.2019, by issuing a writ of mandamus or any other appropriate writ, order or direction as the case may be. C) To direct the respondents no. 3 to 10 to scrutinize and consider the proposals of the petitioners for extending the 1st, 2nd & 3rd benefits of the Revised Assured Career Progression Scheme in the light of the Government Resolution dated 02.03.2019 and various orders passed by this Hon’ble Court in Writ Petitions No. 4571/2021 and 377/2023, pending hearing and final disposal of this petition.
