1. By the present writ petition, the petitioner is seeking a limited prayer for direction towards the respondent authorities for early disposal of the revenue proceeding bearing Revenue Case
2 / 3 No.1-A/68/2018-19 pending before the Court of Tahsildar, Balod, District Balod.

Learned counsel appearing for the petitioner submits that the proceeding under Section 248 of the Chhattisgarh Land Revenue Code, 1959 (For short, “the Act of 1959”) initiated by the Tahsildar, Balod pursuance to the application dated 29/12/2018 (Annexure P/3) moved by the petitioner under Section 248 of the Act of 1959 pursuance to an observation made by this Court in the order dated 04/10/2017 passed in WP(PIL) No.100/2016 and the order dated 22/12/2018 passed by the Board of Revenue. She further submits that though the Tahsildar has taken initiative to decide the application moved by the petitioner but till date no final order has been passed by the Tahsildar.

Learned counsel appearing for the State submits that if the application moved by the petitioner is still pending before the Tahsildar, the same shall be considered and final order will be passed in accordance with the relevant provisions, within the stipulated period.
4. I have heard learned counsel for the parties, perused the documents and the proceeding drawn by the Tahsildar.

From perusal of the pleadings made by the petitioner, it appears that the application dated 29/12/2018 (Annexure P/3) moved by the petitioner under Section 248 of the Act of 1959 pursuance to an observation made by this Court in the order dated 04/10/2017 passed in WP(PIL) No.100/2016 and the order dated 22/12/2018
3 / 3 passed by the Board of Revenue is still pending before the Court of Tahsildar.
6. Perusal of the proceeding drawn by Tahsildar would show that though the Tahsildar has proceeded in the matter but till date, no final order has been passed in the application moved by the petitioner.

In view of the above, the Tahsildar is directed to consider the application dated 29/12/2018 (Annexure P/3) submitted by the petitioner and pass necessary final order by concluding the proceeding in the said application, in accordance with law and on its own merits, within a period of 50 days from the date of receipt of a copy of this order. The petitioner is at liberty to apprise the Tahsildar about the order passed by this Court by producing the same before him.
8. With the aforesaid direction, this writ petition is disposed of.
