HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 9722 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J. Heard Sri Firdaus Ahmad, learned Advocate holding brief of Sri Kanhaiya Lal Tiwari, learned counsel for the petitioners as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for registration on GEM portal maintained by the respondents for the continuous discharge of duties by the petitioners since 2021. He has placed reliance upon the Government Order dated 18.05.2020 in this regard. Learned Standing Counsel on the contrary submits that GEM portal registration is dependent on various factors and not merely upon continuance of a contract employee. More especially when the outsource service provider agency is being engaged. Considering the facts and circumstances of the case especially the fact that petitioner is discharging duties on a contract basis, continuously since 2021, I think it appropriate to dispose of this petition with direction to the petitioners to move their individual representation along with the certified copy of this order within a period of two weeks from today before the respondent no. 2 and in the event representation is made, petitioners' claim shall be considered and disposed of by the competent authority namely the respondent no. 2 by passing appropriate orders within a further period of two months. Needless to add the order to be passed by the competent authority, as Versus Counsel for Petitioner(s) : Kanhaiya Lal Tiwari Counsel for Respondent(s) : C.S.C. Vikas Kumar Sharma And 13 Others .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) directed herein above, shall be reasoned and speaking one.
