1. Heard Mr. A. Baruah, learned counsel for the petitioner. Also heard Mr. R. R. Kaushik, learned Additional Public prosecutor for the State of Assam.
2. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha
Page No.# 2/2 Sanhita (BNSS), 2023, in respect of Gauripur Police Station Case No.424/2024.
3. A person called Dibyajyoti Bora purchased a car from the informant. The price of the car was fixed at Rs.2,40,000/-. After paying Rs.1,90,000/-, he took away the vehicle with a promise that he would pay the remaining amount in monthly installments and thereafter no money was paid to the informant further, when the petitioner approached Dibyajyoti Bora, no money was paid to him.
4. The learned counsel for the petitioner has submitted that her husband is involved in sale and purchase of used cars and he was instrumental in the deal between the informant and Dibyajyoti Bora.
5. According to the petitioner, except that role of her husband, he does not have any other role in the financial transaction between the informant and Dibyajyoti Bora.
6. I have considered the submissions made by learned counsel for both the sides.
7. On a plain reading of the FIR it appears that the present petitioner has been unnecessarily involved into this case and for this reason she does not deserve to be detained in custody.
8. Therefore, the pre-arrest bail prayers made by the present petitioner is allowed.
9. It is hereby directed that in the event of arrest in connection with Gauripur Police Station Case No.424/2024,the petitioner Khurshida Begum shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the arresting authority.
10. The petitioner shall co-operate with the Police Investigating Officer as and when required.
