Present petition has been filed seeking appropriate direction to respondent No.5 and 6 not to harass the petitioners and their family members unnecessarily as they are threatening the petitioners either to withdraw the complaints (Annexures P-1, P-4 to P-6 and P-8), moved against respondent No.7 or they will implicate the petitioners and their family members in some other NDPS cases. Further prayer has been made to transfer the investigation to other District or to constitute the SIT in case FIR No.49 dated 02.06.2025 under Section 61 of the Punjab Excise Act, registered at Police Station Sherpur, District Sangrur. 2. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and FIR has been filed in the present case. He submits that the petitioner is being harassed by respondents No.5 to 7 who are threatening the petitioner as the petitioner has filed the complaint against respondent No.7, who is a Sarpanch of the village. He submits that he has already filed a representation dated 05.06.2025 before respondent No.2, which is POOJA SHARMA 2025.07.31 10:14 I attest to the accuracy and integrity of this document CRM-M-35761-2025 -2- annexed as Annexure P-8. He, further undertakes to file a representation regarding protection of his life and liberty before respondent No.4 i.e. the Senior Superintendent of Police, Sangrur. 3. Notice of motion. 4. On the asking of the Court, Mr. J.S. Arora, D.A.G., Punjab, accepts notice on behalf of the respondent-State. He, on instructions, has submitted that challan is already presented before the trial Court and charges are yet to be framed. 5. In view of the above, no direction regarding the investigation, at this stage, is required to be passed as the investigation is already complete and the case is pending before the trial Court. However, so far as the prayer qua protection is concerned, the present petition is disposed of with liberty to the petitioner to file an appropriate application/petition before respondent No.4, within a period of one week and in case, any such application/petition is filed, the same would be considered expeditiously, in accordance with law.
