2 THE HON’BLE SRI JUSTICE K. SURESH REDDY CRIMINAL PETITION No. 1648 of 2025 ORDER: As per the directions of My Lord the Hon’ble the Chief Justice, this Criminal Petition has been allotted to this Bench by notice dated 25.3.2025 and the same is treated as part of the roster effective from
26.3.3025. 2. This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’), is filed by the petitioner/Accused No.2, seeking anticipatory bail, in Crime No.310 of 2024 of Medikonduru Police Station, Guntur District, registered for the offences punishable under Sections 318 (4), 316 (5) r/w 3(5) of Bharatiya Nagarika Sanhitha, 2023 (for short ‘the BNS’). 3. The case of the prosecution is that the Assistant Director Agriculture, Guntur gave a report to police stating that there are irregularities in payment of input subsidies to farmers of Medikonduru Mandal, wherein an Enquiry Team re-verified the enumeration lists in respect of several villages and reported that an amount of Rs.19,46,272/- was paid to ineligible farmers in Velavarthipadu village towards input subsidies. On the basis of the same, the crime was registered against A1 to A3. 3
4. The allegation made against the petitioner is that she is working as Village Revenue Officer and she furnished login credentials to A1 to issue CCRC cards improperly. The Enquiry Team has given a finding that the petitioner deliberately furnished the login credentials to A1 enabling him to misappropriate money. After granting login credentials by A2, A1 has generated CCRCs at his whims and fancies. It is further alleged that the petitioner failed to discharge her primary responsibility to issue CCRCs and did not even entrust the verification of fields to Village Revenue Officer and also signed final enumerated list without verification of the damaged fields, survey numbers or actual cultivators and thus caused loss to the Government. 5.
In view of the specific allegation made against the petitioner herein, this Court is not inclined to grant Anticipatory Bail to the petitioner. 6. Accordingly, the present Criminal Petition is dismissed.
