Mr. Pawan Attri, Advocate for respondent No.2. **** SANDEEP MOUDGIL , J The jurisdiction of this Court under Section 439 (2) Cr.P.C. has been invoked seeking cancellation of anticipatory bail granted to respondent No.2 in a case bearing FIR No. 144, dated 24.08.2018, under Section 67 of IT Act and Section 509 of IPC, registered at Police Station Haibowal Kalan, District Ludhiana, by this Court vide order dated 25.04.2019. Earlier, the instant petition was dismissed for want of prosecution on 17.02.2025 and subsequently, it was restored vide order dated 07.03.2025 on an application i.e. CRM-8471-2025 moved by the petitioner, subject to payment of costs of Rs. 10,000/- to be deposited with the Chandi Kusht Ashram Society, Sector 46-C, Chandigarh. From the above circumstances, it is evident that the petitioner is not interested in pursuing the matter further, despite having been granted an opportunity following the dismissal of the present petition for non- prosecution. Although the main case was ordered to be restored to its original number vide order dated 07.03.2025, once again, on the present date, the counsel for the petitioner has appeared without instructions. This Court is satisfied that the petitioner has no intention to proceed with the present petition. Accordingly, keeping in view the lack of interest shown by the petitioner and the absence of any useful purpose in keeping the matter pending, the present petition is hereby dismissed for non-prosecution.
