ORDER Heard the learned counsel for the petitioner and the learned counsel for the respondent.
2. The petitioner/wife seeks transfer of HMOP No.1842 of 2025 pending on the file of I Additional Family Court, Chennai to the file of Family Court, Puducherry. 1/4 https://www.mhc.tn.gov.in/judis

3. It is brought to my notice that the petitioner/wife has filed HMOP No.44 of 2024 for dissolution of marriage which is pending before Family Court, Puducherry.
4. The ground on which the transfer is sought for is that the petitioner/wife is a resident of Puducherry and she finds it inconvenient to travel all the way from Puducherry to attend the proceedings pending before Family Court, Chennai.
5. Learned counsel for the respondent/husband vehemently opposes the transfer request since, according to the respondent, the petitioner has suppressed the subsistence of the earlier marriage with another person and has cheated the respondent/husband into getting married with the petitioner and the respondent has already suffered enough at the hands of the petitioner. Therefore, he seeks that no indulgence should be shown to the revision petitioner/wife that too for the convenience of the revision petitioner/wife.

The objections are more on the merits of the main HMOP pending on the ground of nullity and presently, I am concerned only with the request for transfer that has been made by the revision petitioner/wife. The respondent/husband does not deny that the petitioner/wife ordinarily resides at Pondicherry. 2/4 https://www.mhc.tn.gov.in/judis

7. In the light of the above, Tr.C.M.P is allowed and the proceedings in HMOP No.1842 of 2025 pending on the file of I Additional Family Court, Chennai is withdrawn and the same is transferred to Family Court, Puducherry.
8. The I Additional Family Court, Chennai is directed to send the entire records relating to HMOP No.1842 of 2025 to the file of Family Court, Puducherry forthwith.
9. The Family Court, Puducherry shall not insist the physical presence of the respondent/husband on all hearing dates, where it is absolutely necessary. (for the purpose of chief and cross examination). At all the other hearings, the respondent/husband shall be permitted to be represented through counsel. No costs.
