Prajapati, Advocate for the Insurance Company. *** Case file indicates that on account of refusal to accept notice, it was returned to Hon'ble High Court for adjudication on 28.02.2014. This case has again been assigned to this Forum for the purpose of settlement. After due discussions with learned counsel for the parties, a proposal for enhancement of Rs.2,00,000/- more over and above the amount already awarded by MACT was formulated on 11.02.2025. Subsequently, learned counsel for the appellant stopped appearing before this Forum as reflected in order dated 06.03.2025 and 11.03.2025. On 12.03.2025, on the request of learned counsel for the appellant, notice was issued to the appellant to appear in person before this Forum to explore the possibility of settlement. Notice received back served and Mr. Gaurav Tyagi, Advocate put in appearance on behalf of the appellant having been replaced earlier counsel Mr. Johan Kumar, Advocate. He has pointed out that he has been trying to contact the appellant to get concurrence but he did not respond. The conduct of the appellant as reflected in earlier order dated 28.02.2014 referred to above, seems that he is not interested in pursuing his case. In this background, learned counsel for the appellant states that for the time being, this appeal be consigned to record room with a liberty to revive and whenever the appellant contacts him, he will file an appropriate application for revival of the appeal. Accordingly, on the request of learned counsel for the appellant the case is consigned to record room with the liberty aforestated. Copy of this order be given to appellant at the given address.
