The petitioner, through the medium of present petition has challenged
order dated 06.02.2025 passed by the learned Principal Sessions Judge, Budgam whereby the revision petition against order dated 06.06.2024 passed by the Judicial Magistrate, 1st Class, Chadoora has been dismissed and the
order awarding interim maintenance of Rs. 2000/- each in favour of the respondents has been upheld.
After arguing for some time, learned counsel for the petitioner submits that the petitioner would feel satisfied if the petitioner is permitted to pay the arrears of maintenance in easy installments, as he does not have means to pay arrears of maintenance in one go. The statement is taken on record.
Having regard to the submission made, the petition is dismissed as withdrawn and it is provided that the learned trial Magistrate while executing the order dated 06.06.2025 as upheld by the learned revisional court, shall recover the arrears of maintenance in installments to be fixed by the learned trial Magistrate, having regard to the means of the petitioner.
A copy of this order be forwarded to learned trial Magistrate for information and compliance.
