The prayer made in the instant petition is for issuing direction to respondent no.1 to decide the appeal/objection filed on 24.03.2025 and constitute a fresh Medical Board and submit fresh report after affording opportunity of hearing to the petitioners. 2. The petitioners are running a nursing home. On complaint of a patient, who had undergone treatment in the nursing home of the petitioners, Chief Medical Officer constituted a Medical Board. It held a fact finding enquiry and submitted a report on 25.08.2022. The petitioners are stated to have challenged the said report by filing an appeal before respondent no.1 and it is stated to be pending. In the said backdrop, the relief noted above has been claimed. 3. As the appeal is pending before respondent no.1, we find no good ground to direct constitution of fresh Medical Board and leave it open to the petitioner to make all prayers before the appellate authority. 4. Needless to say that the appeal/objection, said to be pending before respondent no.1, will be considered by the said respondent in accordance with law. 5. Disposed of accordingly.
