JUSTICE A.GUNESHWAR SHARMA 28.3.2025 Heard Mr.H.S.Paonam, learned senior counsel assisted by Ms.Malemleima, learned counsel for the petitioner and Mr.S.Niranjan, learned Government Advocate for the State respondents. [2] By the present writ petition petitioner is praying for an innocuous prayer to consider his case for promotion to the post of Station Officer in the Manipur Fire Service, in terms of Recruitment Rules dated 23.10.2015 along with other eligible persons. It is also stated that the petitioner, who is working as Sub-Officer is eligible for promotion to the post of Station Officer and vacancy is available with the retirement of one W.Ranjit, w.e.f. 28.2.2025. [3] Learned senior counsel draws attention of this Court to order dated 19.7.2024 passed by this Court in WP(C) No.877 of 2023 wherein innocuous order was issued for considering case of petitioner therein for promotion to the post of Station Officer in terms of Recruitment Rules against available vacancy. [4] On 7.3.2025, Mr.S.Niranjan, learned Government Advocate sought some time for taking instruction. However, during the course of hearing Mr.Niranjan, learned submits that he has got instruction from the Director, Manipur Fire Service to the effect that without approval of the Home Department, Manipur, Director, Fire Service will not be able to give any proper instruction to the State counsel. [5] Mr.H.S.Paonam, learned senior counsel for the petitioner submits that an innocuous order may be issued to the respondents to consider the prayer of the petitioner along with other eligible candidates and it will not affect the right of any of the eligible employees. [6] This Court has considered the materials on record and submissions made at the Bar. The writ petition is disposed of by directing the respondents to consider the case of the petitioner with other eligible candidates for promotion to the next higher post of Station Officer in the Manipur Fire Service against any vacancy available, in terms of Recruitment Rules, within a period of four months from the date of receipt of a copy of this order. [7] With this observation, the writ petition is disposed. It is made clear that this Court does not express any opinion on the merit of the case.
