This writ petition is not properly drafted but on basis of facts and circumstances of present case, the petitioner i.e. Committee of Management has a very good case and despite the above shortcoming, learned counsel for petitioner has able to convince this Court that initial 15 pages of impugned order has only details of five charges and respective reply of employer and employee only in 15 lines, under heading of सममीकቌኋ the DIOS, Meerut in a verbatim conclusion has held that each charge has no force. For reference the said relevant part is reproduced hereinafter :- "सममीकቌኋ उभय पकኘ᭎ दቌኋरቌኋ ससुनवቌኋई कके समय उपलब्ध करቌኋयके गयके लललखित अभभकथनኘ᭎ , सቌኋቌኚयኘ᭎ एववं पतቌኋवलमी मम उपलब्ध पतቌኋजቌኋतኘ᭎ कቌኋ परमीकण /अनसुशमीलन भकयቌኋ गयቌኋ। लजनकके अवललोकन सके ससथभत भनम्नवत सप्ቖ हलोतमी हहह- 1- ्ቚबन्धक कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 1 तथቌኋ शमी आशቌኋरቌኋम ्ቚवकቌኋ कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 1 कके ्ቚभतउ्ቈर कके अनसुशमीलन करनके पर आरलोप सवंख्यቌኋ 1 मम आरलोभपत आरलोप बलहमीन हह। 2- ्ቚबन्धक कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 2 तथቌኋ शमी आशቌኋरቌኋम ्ቚवकቌኋ कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 2 कके ्ቚभतउ्ቈर कके अनसुशमीलन करनके पर आरलोप सवंख्यቌኋ 2 बलहमीन व भनरቌኋधቌኋर हह। 3- ्ቚबन्धक कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 3 तथቌኋ शमी आशቌኋरቌኋम ्ቚवकቌኋ कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 3 कके ्ቚभतउ्ቈर कके अनसुशमीलन करनके पर आरलोप सवंख्यቌኋ 3 भनरቌኋधቌኋर व बलहमीन हह। 4- ्ቚबन्धक कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 4 तथቌኋ शमी आशቌኋरቌኋम ्ቚवकቌኋ कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 4 कके ्ቚभतउ्ቈर कके अनसुशमीलन करनके पर आरलोप सवंख्यቌኋ 4 भनरቌኋधቌኋर व बलहमीन लस्ቍ हलोतቌኋ हह। 5- ्ቚबन्धक कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 5 तथቌኋ शमी आशቌኋरቌኋम ्ቚवकቌኋ कके अभभकथन मम वभणरत आरलोप सवंख्यቌኋ 5 कके ्ቚभतउ्ቈर कके अनसुशमीलन करनके पर आरलोप सवंख्यቌኋ 5 बलहमीन व आधቌኋरहमीन हलोनके कके कቌኋरण लस्ቍ नहीሻ हलोतቌኋ हह। " Learned counsel for DIOS has miserably failed to convince this Court that above referred conclusion has assigned any reason whatsoever. It appears that DIOS, Meerut has put only his signature on impugned order, without even looking into the order. He has signed the impugned order with closed eyes. In the aforesaid circumstances, since petitioner has constrained to approach this Court to challenge an unreasoned order, therefore, not only impugned order dated 27.12.2024 is set aside but a copy of this order is directed to be sent to respondent Nos.1 and 2 so that an appropriate decision be taken that why not disciplinary inquiry be initiated, if circumstances so warranted against respondent No.3 since he has not discharged his official duties diligently.
